CA Eviction Law - Owner/Roommate Ocupied REO

Just got a new assignment and it is occupied by the owner and his roommate.  He has leased out two of the bedrooms to this roommate.

I am trying to figure out if this roommate's lease makes this a 90 day eviction vs. the standard 3 day owner occupied eviction.

Any insight would be awesome!

  • I had a similar assignment (I'm in Nor Cal) Alameda county. The previous owner and the (roommate) tenant have to provide a valid lease, if they do it is a 90 day eviction for the tenant. My understanding was the previous borrower still gets the standard 3 day. Which makes it messy for the eviction. CFK!!! In my assignment they did provide a valid lease. Both the previous borrower and the tenant received CFK!!! (for both) to leave in 30 days. Go Giants!!!
